Islamabad: In a significant legal development, the bench of the Islamabad High Court (IHC) hearing appeals filed by jailed human rights lawyer Imaan Mazari and her husband Hadi Ali Chattha against their conviction in the controversial tweets case has been dissolved.
According to details, IHC’s Justice Mohammad Asif, who was presiding over the matter, forwarded the case file to Chief Justice Sarfraz Dogar for further directions on Monday.
In a written order, the judge observed that Justice Azam Khan had previously heard similar cases. Therefore, to ensure procedural consistency, the file is being sent to the chief justice for the constitution of an appropriate bench.
Background of the Appeals
Imaan Mazari and Hadi Chattha had filed applications seeking an early hearing of their appeals against the sentences awarded to them by a trial court. On February 19, 2026, the IHC had issued a notice to the National Cyber Crime Investigation Agency (NCCIA) on the couple’s pleas, seeking the suspension of their sentences.
Arguments Presented in Court
During the last hearing, senior counsel Faisal Siddiqui, along with Zainab Janjua and other lawyers, represented the appellants. Siddiqui argued that the trial court had announced its verdict despite a pending petition seeking the transfer of the case.
He further contended that the statements of two key witnesses were recorded in the absence of the accused, violating their right to a fair trial.
“Nobody can stop the court from giving a sentence. But at least give suspects the right to a fair trial,” Siddiqui submitted, emphasizing the need for due process.
Next Steps
Following the dissolution of the bench, the matter now awaits listing before a newly reconstituted bench. The court has yet to announce the next date for the hearing of the appeals.
